In these Terms and Conditions:
"we", "us" or "our" refers to: Fenestram Blinds Ltd, 6 Shelley Drive, Higham Ferrers, Rushden, NN10 8DF and "you" or "yours" refers to the user of this site and anyone who purchases or tries to purchase blinds using the information, tools or other data available on this site.
This page (together with the documents and other terms referred to on it) tells you the terms of use on which you may make use of our website www.fenestram.co.uk (our site). Please read these terms of use carefully before you start to use the site. By continuing to use our site, you indicate that you accept these terms of use and that you agree to abide by them. No other terms and conditions shall apply to your use of this site and If you do not agree to these terms of use, please refrain from using our site.
We regret we cannot accept orders placed by persons located or resident outside England, Scotland and Wales.
Acceptable use policy
When using our site, you must use our site only for lawful purposes. You may not use our site:
In any way that breaches any applicable local, national or international law or regulation.
In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
For the purpose of harming or attempting to harm minors in any way.
To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

You also agree:
Not to reproduce, duplicate, copy or re-sell any part of our site in contravention of the provisions of these terms of use.
Not to access without authority, interfere with, damage or disrupt:
any part of our site;
any equipment or network on which our site is stored;
any software used in the provision of our site; or
any equipment or network or software owned or used by any third party.

Intellectual property rights
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.
You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or from our licenses provider.
If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Samples
The product information and photographs contained within our website are provided for illustrative purposes only and we cannot warrant that they are accurate, as photographs rarely give a “true” reflection of a colour. If you are in any doubt as to the precise nature of the colour and/or fabric you wish to order, you are strongly advised to order a free fabric sample.
Please note that the receipt of a sample does not guarantee the availability of that fabric or material when your order is received. On rare occasions, our supplier's stock of a fabric or material may be exhausted by the time an order is made in response to a sample. If that happens, we will notify you by e-mail after receipt of your order and we will give you the option to (i) choose alternative fabric or materials at no additional cost to you or (ii) request a refund of any monies we have received from you in relation to that fabric or material.

Measurement and Order
As the goods which you order are manufactured according to the measurements you provide in your order and we rely on you to provide accurate measurements. We cannot take any responsibility for inaccurate measurements.
We work to a manufacturing tolerance of +/- 5mm, blinds cannot be rejected on a size dispute if the size falls inside our manufacturing tolerance.

Order by phone or email:
Our sales team can raise a manual order from details provided by telephone or email, the order acknowledgement will then be raised in the form of email and sent to the email address you have provided, it is then your responsibility to read carefully and check ALL the details are correct, we require a reply confirmation via email from you that you are happy with the details we have provided. 
The order will only then be put into production; we Fenestram Blinds Ltd do not accept any claims based on incorrect specifications or measurements being inputted by us.
If you would like guidance on how to take the required measurements accurately, call our enquiry line on 01933 388 388 or contact us by email info@fenestram.co.uk. Any dispute with regards to your measurement's and or the fitting of your blind, or blinds, would need to be supported by pictures of the blind and area the blinds are intended for.

Our Guarantee
We warrant that all goods sold to you will be free from defects in material and workmanship for a period of 12 months from delivery of the goods to you.
As your sole remedy for any breach of our guarantee above, we will either (i) repair or (ii) replace your blind free of charge with a product of similar quality and specification - providing the goods have not been modified, misused or been treated negligently by you or on your behalf. This does not affect your statutory rights.
Notwithstanding the generality of the foregoing, please note that wood is a natural product and there may be some colour and grain variation between slats. Over time there may be a mellowing of colour depending on exposure to the sun. You may find that the surroundings will effect the way your blind reacts as the slats can absorb and release moisture, especially in steamy environments such as kitchens/bathrooms and extreme temperatures. A small amount of warping could be experienced and as it is a natural condition of wood this would not warrant a replacement blind or repair to a blind.
It is your responsibility to ensure that the products supplied / fitted by us are in fully working order and satisfactory. Any damages must be reported to our office in 7 working days after the delivery / installation date.
You will need to have contacted us via email/telephone or in writing at the address given on our contact us page, giving us full details of the fault. 
Any dispute as to the quality of the product would need to be supported with a professional independent report (along with photographs), explaining why you believe the blind is defective.


Cancellation and Returns
We reserve the right to cancel your order if we have insufficient stock to deliver the goods you have ordered or if the fabric you have selected has been discontinued. You will be informed by email and offered an alternative. If these are not suitable then a full refund of the blind in question will be re-credited to your account within 10 days of your order and the order will be terminated. We will not be obliged to offer any additional compensation for the disappointment suffered.
Custom-made goods cannot be returned to us if you are not happy with the style, colour or fabric style you selected. If the blinds or the curtains and accessories are within the product specifications, fit for purpose and non-faulty these cannot be returned or refunded. 


The Consumer Protection (Distance Selling) Regulations 2000:
Orders cannot be changed or cancelled the blinds are custom made "bespoke" to your own requirements, and are not re-saleable. 
Once your order has been accepted by us and entered into our manufacturing process at the time of payment. The contract between Fenestram Blinds Ltd and you the customer begins, this contract does NOT entitle you to a 7 day cooling off period.
We will advise you whether the goods should be returned to us if it appears that the goods are defective. We will advise on how to pack your goods ready for collection to return them to us. Return of the goods does not entitle a full refund of purchase price or postage costs incurred, the goods will remain the customers property, until proof of unfit for propose had been proven by an independent professional body on behalf of both parties, would a full refund be given.
Please note that we can not accept a return of the goods for any of the following reasons:
If the measurements provided in the order are incorrect.
For minor or immaterial variations or changes in colour or pattern between the sample or description on our site and the goods delivered.

Our Liability
The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:
all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it any liability for:
loss of income or revenue;
loss of business;
loss of profits or contracts;
loss of anticipated savings;
loss of data;
loss of goodwill;
wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
Subject to the foregoing provisions as to liability, our liability for all losses, expenses, costs, fees or charges arising out of or in relation to this site are limited to the value of the order in relation to which the claim arose.

Safety - Child safety WARNING
In the interest of safety consider your blind control position, please keep all pull cords and chains out of the reach of children. Move cots beds and other furniture away from blinds and install safety devices, such as cleats and cord tidies, to limit access to cords. Hanging cords can be a potential risk to children, so the greatest care needs to be taken at all times.
